Domestic Violence

Domestic violence should not be taken lightly. It destroys families and threatens the well-being of spouses and children. Whereas one partner may commit an act of domestic violence to exert power and control, the other person may feel powerless. If you or a loved one is the victim of domestic violence, or if you fear your partner will commit an act of domestic violence, speak with a domestic violence lawyer in Orlando, Florida, today.

At the Llabona Law Group, we handle all family law cases, including domestic violence cases. We have and can represent the petitioner, often referred to as “the victim,” or the respondent, often referred to as “the accused,” in domestic violence cases.

Domestic violence comes in many forms. It includes physical abuse, such as a battery or sexual assault. According to Florida law, actions such as stalking or kidnapping can also be interpreted as domestic violence. Any action by one household member against another that could result in injury or death may be an act of domestic violence.

We Represent the Victim or the Accused

Accusations of domestic violence can cut both ways in a divorce. When a judge believes the accusation of spousal or child abuse, the result may be a restricted time-sharing schedule for the abusive parent. However, making a false allegation of domestic violence can result in loss of time-sharing with the child by the accuser. If you are accused of domestic violence, it is vital to seek legal advice as soon as possible. A domestic violence injunction is a restraining order, and it can affect you both personally and professionally.

Generally speaking, employers are not interested in hiring an employee who has a restraining order for domestic violence on his or her record. If you are a police officer, a domestic violence injunction can result in a loss of employment since you would not carry a gun.

Domestic Violence Information

Pursuant to Florida Statute Section 741.30, any person who is either the victim of domestic violence as defined in Florida Statute Section 741.28 or has reasonable cause to believe he or she is in imminent danger of becoming the victim of any act of domestic violence has standing in the circuit court to file a sworn petition for an injunction for protection against domestic violence. The court shall consider and evaluate all statutory factors alleged in the petition and/or presented at a hearing, if any.

Should the court find that the petitioner is a victim of domestic violence or has reasonable cause to believe he or she is in imminent danger of an act of domestic violence, they will enter a final judgment for injunction for protection. The final judgment excludes the respondent from going to the petitioner’s workplace, home, or otherwise getting close to the petitioner. The final judgment may also award the petitioner or the respondent exclusive use and possession of the parties’ home. It may establish a time-sharing schedule for the parties’ children and order child support.
